On 25 October 2017, the Italian Competition Authority (ICA) adopted an order against the Irish airline Ryanair, as a result of the flight cancellations occurred in September and October, requiring it to provide clear, transparent and immediately accessible information to Italian consumers in accordance with Regulation (EC) No 261/2004.

Within ten days from the receipt of the order, Ryanair should have sent the ICA a detailed report explaining the actions undertaken to fulfil with these obligations.

Ryanair did not comply with the provisions of the ICA order. This behavior continued even after the Regional Administrative Court of Lazio, by order dated 22 November 2017, rejected the airline’s request to suspend the execution of the ICA order. Therefore, on 29 November 2017, the ICA decided to initiate a non-compliance procedure against Ryanair.

The non-compliance procedure may lead to the imposition of a pecuniary administrative sanction of between 10,000 and 5,000,000 euro.
