Air transport. Court of Justice rules on the protection of airport users’ rights
Directive 2009/12 prevents airport managing bodies from determining, together with an airport user, airport charges different from those set by that body and approved by the independent supervisory authority. Furthermore, it allows airport users to challenge directly the decision of the independent supervisory authority approving the charging system.

When the court of a Member State hears an action for both the standardized rights provided for by Regulation 261/2004 and compensation for further damage falling within the scope of the Montreal Convention, it must determine its jurisdiction in light of Regulation 1215/2012 and of Article 33 of that Convention. Furthermore, Article 33 governs not only the allocation of jurisdiction as between States, but also the allocation of territorial jurisdiction (venue) among the courts of each of those States.
